| LEAVES OF ABSENCE FOR
CONTRACTUAL PERSONNEL
Leaves of absence, without pay, may be
granted. All requests for leaves of absence must be submitted to the
superintendent or his designee. In no event shall a leave of absence be
granted or extended beyond the then existing termination date of the
employee's contract. No employee under a contract for one (1) year or less
shall be entitled to the benefits of this policy should it have the effect
of extending the contract term.
Reasons for Leave of Absence
Temporary disability, illness in the immediate family, and education
leave are possible reasons for granting a leave of absence.
Temporary Disability
A leave
of absence for a temporary disability for full-time educators shall be
provided by the Irving
Independent School District in
accordance with Section 21.409, Texas Education Code. A leave of absence
for temporary disability shall be provided at any time the employee's
condition interferes with the performance of regularly assigned duties.

Illness in the Immediate Family
A leave
of absence for this reason may be granted for a semester or a school
year.
Education Leave
Education Leave may be granted for a semester or for a school year to
enroll in an education program to work on an advanced degree, additional
teaching field, or certification endorsement.
Reassignment after Leaves of Absence
A leave of
absence for more than 12 weeks shall be from the faculty of the district and
not from a specific assignment. Reassignment is contingent upon a vacancy
in the educator’s field of preparation and determination that the educator
on leave of absence is the best certified and qualified applicant for the
vacancy.
Jury Duty
COUNTY: Employees called
for county jury duty shall receive their regular pay plus the per diem
paid by the county provided the employee furnishes the business office a
certificate of service, available from the bailiff in the central jury
room, or some other proof of service. A copy of the check showing such
payment is acceptable proof of service.
FEDERAL: Employees called
for federal jury duty shall receive their regular pay plus the per diem
paid by the federal government provided the employee furnishes the
business office with a certificate of attendance, available from the jury
clerk, or some other proof of service. A copy of the check showing
payment is acceptable proof of service.
Witness Duty: The District
shall not discharge, discipline, or otherwise penalize an employee because
the employee complies with a valid subpoena to appear in a civil,
criminal, legislative, or administrative proceeding. Art. 5207(c),
V.A.T.S.
Records of Absence:
Appropriate records describing the nature and length of absence shall be
executed by employees upon their return to duty.
