Senate Bill 865 (SB 865) - Cardiac Emergency Response Plan (CERP)
- Each school district and private school shall develop and implement a cardiac emergency response plan that establishes safety procedures for a district or school employee or other appropriate personnel to follow in responding to a medical emergency involving cardiac arrest on district or school grounds.
- The plan must include:
- Establishment of a cardiac emergency response team
- Procedures for activating the CERP team
- Dissemination of the plan throughout each campus
- Ongoing training in CPR/First Aid and use of an AED.
- Annual practice drills
- Annual review and evaluation
- Implementation of Project Adam planned for Fall 2025

- Q: Does prior parental consent have to be provided for first aid?
- A: No. It does not require prior active consent of a parent. First Aid is a health-related service and should be provided unless the parent has specifically notified the district of their choice to decline this service. (TEC, 26.0083(g))
- Q: Can our staff provide general caretaking?
- A: Yes. General caretaking is not considered a health-related service or a health-care service subject to SB12. (TEC, 26.0083(b)(11), (m))
- Q: What will be provided for my child on campus daily?
- A: First Aid (bandages, bloody nose, checking temperature, general questions surrounding how your child feels)
- Assessment (for specific complaint or concern)
- Routine Screenings (vision, hearing, spinal, and Texas Risk Assessment for Type 2 Diabetes in Children according to Texas Administrative Code, Title 25, Chapter 37 )
- Wellness promotion and education (nutrition, hygiene, prevention, wellness) beyond what is taught through grade level or course instruction
- Q: Will I have to consent for emergency services to be rendered to my child?
- A: No. Safety of children comes first. (life-saving and resuscitation measures will be implemented for your child)
- Q: Can I opt out at any time?
- A: Yes. Declination of any service(s) can be submitted in writing to the campus nurse. Should a parent decline health-related services, it is the expectation of Irving ISD that parents will be at the campus to take care of any health services needs for their child within 30 minutes.
